1. Introduction & Acceptance
These Terms of Service ("Terms") govern your use of scout.motlogs.com and the Scout platform (the "Service"), operated by MOT LOGS LTD, a company registered in England and Wales under company number 16394000, with its registered office at 27 Old Gloucester Street, London, United Kingdom, WC1N 3AX ("we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Description of the Service
Scout is a vehicle risk assessment tool for car auction buyers. The Service allows you to search vehicle registration numbers and receive MOT history summaries, risk scores, AI-generated narratives, advisory information, and related vehicle data.
The Service is designed as an informational aid only. It is not a substitute for professional vehicle inspection, independent mechanical assessment, or legal advice.
3. Open Government Licence Attribution
The vehicle and MOT data presented through this Service is sourced from the Driver and Vehicle Standards Agency (DVSA) and the Driver and Vehicle Licensing Agency (DVLA).
Contains public sector information licensed under the Open Government Licence v3.0.
The underlying MOT and vehicle data remains Crown Copyright and is published by the DVSA under the Open Government Licence. We reproduce, adapt, and present this data in compliance with the licence terms. The OGL does not grant any official status or imply endorsement by the DVSA, DVLA, or HM Government.
4. DVSA Data Disclaimer & Limitation of Liability
Scout is a secondary processor of publicly available DVSA data. We present this data "as is" after ingestion, vectorisation, and AI-assisted analysis. You acknowledge and agree that:
- No real-time guarantee. The data displayed may not reflect the most current MOT status, advisory notices, or vehicle registration details. There may be a delay between when the DVSA updates its records and when those changes appear in our system.
- No accuracy guarantee. While we take reasonable steps to ensure data integrity during ingestion and processing, we do not warrant that the data is complete, accurate, or free from errors. Data may be affected by upstream errors in DVSA records, processing artefacts, or system limitations.
- No reliance for critical decisions. You must not rely solely on information provided by Scout when making legal, financial, or safety-critical vehicle purchasing decisions. Always commission an independent vehicle inspection (e.g. AA, RAC, or RICS) and verify MOT status directly with the DVSA at check-mot.service.gov.uk before completing any purchase.
- AI-generated content. Risk scores, AI summaries, mechanic summaries, and garage guidance are generated by automated systems. They represent probabilistic assessments, not professional opinions or guarantees. AI outputs may contain inaccuracies.
4.1 Limitation of Liability
To the maximum extent permitted by the laws of England and Wales:
- We shall not be liable for any loss, damage, or expense (whether direct, indirect, consequential, special, or incidental) arising from your use of or reliance on the data, risk scores, or AI-generated content provided by the Service.
- Our total aggregate liability to you for any claims arising from your use of the Service shall not exceed the total fees you have paid to us in the 12 months preceding the claim.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded under the laws of England and Wales.
5. User Accounts & Registration
To access certain features, you must register an account by providing a valid UK mobile phone number and completing OTP verification. You agree to:
- Provide accurate and current information.
- Keep your account credentials secure.
- Notify us immediately of any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
6. Subscriptions & Payments
Paid subscription plans are available and billed on a recurring monthly basis via Stripe. By subscribing, you agree to the following:
- Billing: You will be charged the subscription fee at the start of each billing period. Fees are stated inclusive of VAT where applicable.
- Free trial / free checks: We may offer a limited number of free vehicle checks before requiring a subscription. Free allowances are subject to change.
- Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing period. No partial refunds are given for mid-period cancellations.
- Price changes: We may change subscription prices with at least 30 days' written notice. Continued use after the effective date constitutes acceptance.
- Refunds: As the Service provides immediate access to digital content upon payment, you acknowledge that you forfeit your 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once the Service is accessed.
7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Infringe the rights of any third party.
- Transmit malware, viruses, or other harmful code.
- Attempt to gain unauthorised access to our systems, servers, or databases.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service for any purpose that is fraudulent, deceptive, or misleading.
8. Prohibition of Automated Access & Scraping
You must not, without our prior written consent:
- Use any automated system, software, bot, spider, scraper, crawler, or similar technology to access, extract, harvest, index, or reproduce any data from the Service, its UI, or API.
- Systematically download, copy, or store data obtained from the Service for the purpose of creating or augmenting a competing product, dataset, or service.
- Circumvent, disable, or interfere with any rate-limiting, authentication, anti-scraping, or other technical protection measures implemented by the Service.
- Access the Service through any means other than the interfaces we intentionally provide (i.e. the web application at scout.motlogs.com).
- Resell, sublicense, or redistribute data obtained from the Service, whether in raw or processed form.
Violation of this clause may result in immediate account termination, permanent IP bans, and legal action for damages, including recovery of infrastructure costs incurred as a result of abusive automated access.
9. Intellectual Property
All intellectual property rights in the Service (including but not limited to the user interface, software, design, branding, risk-scoring algorithms, AI models, and editorial content) are owned by or licensed to MOT LOGS LTD.
The underlying vehicle and MOT data is Crown Copyright, licensed under the Open Government Licence v3.0 (see Section 3). Our analysis, risk scores, summaries, and presentation of that data constitute original works protected by copyright.
You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written permission, except as expressly permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless MOT LOGS LTD, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms.
- Your violation of any applicable law or regulation.
- Your misuse of data obtained from the Service.
- Any unauthorised automated access to the Service by you or through your account.
11. Service Availability & Modifications
We aim to provide uninterrupted access to the Service but do not guarantee availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any such changes.
12. Third-Party Services
The Service integrates with third-party providers including Stripe (payments) and the DVSA (data source). We are not responsible for the availability, accuracy, or conduct of third-party services. Your use of third-party services is governed by their respective terms and policies.
13. Termination
We may suspend or terminate your access to the Service immediately, without prior notice, if:
- You breach any provision of these Terms.
- We are required to do so by law.
- We reasonably believe your account is being used fraudulently or abusively.
Upon termination, your right to use the Service ceases immediately. Sections 4, 8, 9, 10, and 14 survive termination.
14. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MOT LOGS LTD regarding the use of the Service.
